HyHost - Terms of Service

1. Acceptance of Terms
By registering an account, accessing, or using any services offered by HyHost ("we," "us," or "our") at [www.hyhost.cc] (the "Website"), you ("User," "you," or "your") agree to be fully bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services. We reserve the right to modify these Terms at any time, and continued use of our services after any modification constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 13 years of age to use HyHost. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you represent that all information you provide is accurate, current, and complete.
3. Services
HyHost provides Hytale game server hosting services. We currently offer the following server plans:
- Hyspark - Entry-level server hosting plan
- Hyforge - Mid-tier server hosting plan
- Hyapex - Premium server hosting plan
All plans are subject to the specific resource allocations, limitations, and features described on our Website at the time of purchase. We reserve the right to modify, update, or discontinue any plan at any time with reasonable notice.
4. Account Registration
To purchase and manage a server, you must register for an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access or breach of security
HyHost is not liable for any loss or damage arising from your failure to comply with these obligations.
5. Billing and Payments
5.1 Billing Periods
All server plans are available on the following billing cycles:
- Monthly - Billed every 30 days
- Quarterly - Billed every 3 months
- Yearly - Billed every 12 months
5.2 Automatic Renewal
Unless cancelled before the end of the current billing period, all subscriptions automatically renew for the same billing period at the then-current rate.
5.3 Payment
All payments must be made in advance. We accept payment methods as listed on our Website. You authorize HyHost to charge your selected payment method on a recurring basis for the applicable billing period.
5.4 Price Changes
HyHost reserves the right to adjust pricing at any time. We will provide at least 14 days' notice before any price change takes effect. Continued use of the service after the effective date constitutes acceptance of the new pricing.
5.5 Taxes
You are responsible for any taxes, levies, or duties applicable to your purchase based on your jurisdiction.
6. Refund Policy
6.1 New Subscriptions
We offer a 7-day money-back guarantee for new subscriptions only. If you are not satisfied with your service, you may request a full refund within 7 days of your initial purchase by contacting our support team.
6.2 Renewals
Refunds are not provided for renewal charges. You are responsible for cancelling your subscription before the renewal date if you do not wish to continue.
6.3 Exceptions
No refunds will be issued in cases of service termination due to violations of these Terms.
7. Acceptable Use Policy
You agree not to use HyHost services to:
- Violate any applicable local, national, or international laws or regulations
- Infringe upon the intellectual property rights of Hytale, Hypixel Studios, or any third party
- Host, transmit, or distribute malware, viruses, or any malicious code
- Conduct unauthorized DDoS attacks, port scanning, or network disruption activities
- Engage in fraudulent activity, impersonation, or deception
- Distribute or facilitate the distribution of pirated game software or mods
- Harass, threaten, or abuse other users
- Resell or sublicense the hosting service without explicit written permission from HyHost
HyHost reserves the right to immediately suspend or terminate any account found in violation of this policy without prior notice and without refund.
8. Service Availability & Uptime
HyHost strives to maintain a 99.9% uptime for all server plans. However, we do not guarantee uninterrupted service. Scheduled maintenance, hardware failures, network outages, or events beyond our control ("Force Majeure") may cause temporary service interruptions. We will attempt to provide advance notice of scheduled maintenance where possible.
9. Data & Backups
HyHost may offer automated backups as part of certain plans. However, you are solely responsible for maintaining your own backups of any server data, configurations, and files. HyHost shall not be liable for any data loss under any circumstances.
10. Intellectual Property
All content on the HyHost Website, including logos, text, graphics, and software, is the intellectual property of HyHost or its licensors. You may not copy, reproduce, distribute, or create derivative works without our express written consent. HyHost is not affiliated with, endorsed by, or in partnership with Hypixel Studios or the Hytale game.
11. Termination
HyHost reserves the right to suspend or permanently terminate your account and services at our sole discretion, with or without cause, with or without notice. Upon termination:
- Your access to the service will be revoked immediately
- Any data stored on your server may be permanently deleted after 7 days
- Outstanding balances remain due and payable
You may cancel your account at any time through your account dashboard or by contacting support.
12. Limitation of Liability
To the maximum extent permitted by applicable law, HyHost and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount paid by you to HyHost in the three (3) months preceding the claim.
13. Disclaimer of Warranties
The services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
14. Governing Law
